I. General Statement of Ownership

This website, and the network of websites and digital storefronts associated with it (collectively, the "Network"), is owned, operated, and maintained by Confused Productions, LLC, a limited liability company formed under the laws of the State of Colorado.

Unless otherwise noted, all content, features, and functionality—including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof—are owned by Confused Productions, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

II. Protected Works and Assets

Confused Productions, LLC asserts clear and unequivocal copyright ownership over the following distinct categories of works created, produced, or commissioned by the Company:

A. Audio and Literary Works (Podcasting)

The Company creates scripted audio entertainment. Copyright protection is claimed in the sound recordings, the underlying scripts/literary compositions, and the unique show formats of:

  • "Helium Headspace" (First publication: 2025)
  • "Ink & Oxygen" (First publication: 2025)

B. Audiovisual Works

The Company claims copyright in the visual direction, editing, script, and production of the series "The Confused Idealist," distributed via YouTube and the Network.

C. Visual Arts and Merchandise (The Shy Phoenix)

Through its retail division, The Shy Phoenix, the Company creates and distributes apparel and goods. The Company claims copyright protection over:

  • Original graphic designs, logos, and artwork created by the Company.
  • Original product photography and visual staging (excluding vendor-provided stock imagery).
  • The compilation and specific derivative arrangement of any public domain elements utilized in merchandise designs.

III. Third-Party Rights and Disclaimers

Confused Productions, LLC respects the intellectual property rights of others and operates in strict accordance with third-party licensing agreements.

  • Public Domain Materials: Certain content or merchandise designs may incorporate elements currently in the public domain. Confused Productions, LLC does not claim ownership of the underlying public domain works but expressly reserves all rights to the digital restoration, significant artistic alteration, and derivative works created by the Company using such elements.
  • Musical Licensing: Audio branding, intro/outro music, and background compositions utilized in our productions are either original works of the Company or are licensed for commercial use via reputable libraries or software platforms (e.g., Apple GarageBand) in accordance with their respective End User License Agreements (EULA).
  • Interview Subjects: The voices, likenesses, and contributions of guests appearing on our podcasts or video series are used pursuant to written Guest Release Forms on file with the Company.

IV. Limited License for Personal Use

These Terms permit you to use the Network for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Network, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may download a single copy of our podcasts or video content for your personal, non-commercial use, provided you do not modify the content or delete any proprietary notice.

Prohibited Actions:

You must not access or use for any commercial purposes any part of the Network or any services or materials available through the Network without the express written consent of Confused Productions, LLC.

V. Trademarks

The Company name, Confused Productions, LLC, the terms "The Shy Phoenix,""Helium Headspace," "Ink & Oxygen," "The Confused Idealist," and all related names, logos, product and service names, designs, and slogans are trademarks or trading names of the Company or its affiliates. You must not use such marks without the prior written permission of the Company.

VI. Digital Millennium Copyright Act (DMCA) Notification

We take claims of copyright infringement seriously. We will respond to notices of alleged copyright infringement that comply with applicable law. If you believe any materials accessible on or from this Network infringe your copyright, you may request removal of those materials (or access to them) by submitting written notification to our Copyright Agent designated below.
